As for charts, it goes by actual data on the chart, so if you happen to be missing the 4189.75 quote, it won't be on the chart and thus not show. if using a Level I datafeed that aggregates data (TD Ameritrade, IB) the peak quote could be one that was aggregated and thus missed.
